1.Purpose and scope

These terms and conditions of sale (the “Terms”) govern the relationship between Brazil Vip Tailor-Made Tours Viagens e Turismo Ltda. (“Brazil Vip”) and any person who books a trip with it (the “client”).

They apply to tours and stays that combine several services in Brazil (accommodation, transfers, tours, domestic flights). Stand-alone bookings (a single hotel night, flight, transfer or tour) are subject to each supplier’s own conditions, which are provided to the client before booking.

Confirming a trip constitutes acceptance of these Terms and of any specific conditions stated in the quote.

2.Quote and contract

Each trip is subject to a free, personalized quote, prepared according to the dates, the number of travelers and the services requested. The quote specifies the services included and not included, the price and any specific conditions.

Prices shown on the website are for guidance only (“from” prices, per person, based on two travelers, excluding international flights). Only the confirmed quote is binding.

The contract is formed when the client accepts the quote, in writing or by any electronic means, and Brazil Vip receives the deposit provided for in Article 3.

3.Confirmation and payment

Deposit

The booking becomes final upon receipt of a deposit of at least 30% of the total price, together with the information requested (names exactly as they appear on passports, dates of birth, flight numbers, etc.).

For trips over New Year’s, Carnival and other holiday or event periods, the deposit may be higher: in that case it is set according to the local suppliers’ conditions and stated in the quote.

Balance

The balance is payable no later than 30 days before the start of the trip. For any booking made less than 30 days before departure, the full price is due upon confirmation.

Failure to pay the balance on time may be treated as a cancellation by the client and give rise to the fees provided for in Article 6.

Payment methods

  • Credit or debit card: payment is made exclusively through the secure WeTravel payment platform.
  • Bank transfer: through the WeTravel platform, or directly to Brazil Vip’s account in euros or US dollars.

Bank details and the WeTravel payment link are provided with the invoice. Any bank or currency exchange fees charged by the client’s bank are borne by the client.

An invoice is sent to the client after receipt of the deposit.

4.Price

Prices are expressed in US dollars and calculated from rates in Brazilian reais. They are set per person and depend on the number of travelers on the same booking.

Once the contract is formed, the price is firm and final.

It may be revised only in the event of an extraordinary change of more than 30% in the exchange rate between the Brazilian real and the US dollar. Any such revision applies only to services paid in reais, excluding international flights, and the client is notified in writing.

If one or more travelers on the same booking cancel, the per-person price for the remaining travelers may be recalculated. Refusal to pay this new price is deemed a cancellation.

5.Changes requested by the client

Any change request (hotel, dates, transfers, meals, tours) must be made in writing. Brazil Vip will do its best to accommodate it, subject to availability and to the suppliers’ conditions.

Changes requested less than 30 days before departure may incur additional fees, payable no later than 10 days before the start of the trip.

Once airline tickets have been issued, any change of flight, date or name (including a spelling correction) is treated as a cancellation followed by a new booking and may incur the corresponding fees. The client must therefore make sure that the first and last names provided are identical to those in their passport.

6.Cancellation by the client

Any cancellation must be notified in writing (by email to contact@brazilvip.com). The date the notification is received is used to calculate the fees.

An administrative fee of US$50 per person is retained in all cases. In addition, the following fees apply as a guideline, calculated on the total price of the trip:

Cancellation date

Fees retained

More than 90 days before departure

20%

Between 90 and 30 days before departure

30%

Less than 30 days before departure

100%

After the trip has started

100%, no refund

For trips over New Year’s, Carnival and other holiday or event periods, suppliers often require non-refundable advance payments: these amounts cannot be refunded, regardless of the cancellation date. They are indicated in the quote.

Airline tickets are issued in the passenger’s name and are non-assignable and non-transferable. In the event of cancellation, any refund is governed exclusively by the airline’s conditions.

Expenses incurred by the client outside the trip (visas, documents, vaccinations, insurance) are non-refundable.

For group trips, the withdrawal of one or more participants may increase the cost of shared transfers and tours: the corresponding share is not refunded, so as not to penalize the other travelers.

This schedule is a guideline. The final refund amount may vary depending on each supplier’s own cancellation conditions (hotels, airlines, guides, transport providers) and on the exchange rate between the Brazilian real and the US dollar at the time of the refund.

In the event of cancellation, Brazil Vip undertakes to negotiate with each of its suppliers in order to refund the highest possible amount to the client.

Refunds due are made by bank transfer within a maximum of 10 business days from receipt of the cancellation request.

7.Air travel

Flight schedules, airports, aircraft, airlines and routings may be changed by the carriers, sometimes without notice. These changes, as well as delays, cancellations or additional stopovers, are the responsibility of the airlines. Brazil Vip will adjust the itinerary as best it can, but such events do not give rise to any compensation from Brazil Vip.

If a flight is delayed by more than 2 hours, a surcharge may be requested for the driver’s or guide’s waiting time.

Baggage allowances vary by airline and on domestic flights: it is the client’s responsibility to check them. Baggage remains the responsibility of the client and the carrier.

8.In-country services

Unused services (transfers, excursions, hotel nights, flights) are not refundable.

Changes decided by the client during the trip are subject to the local suppliers’ conditions. Additional or replacement services are paid directly to the suppliers.

The order of tours may be adjusted depending on the weather, water levels, road conditions or opening hours, without changing the spirit of the trip. Wildlife sightings can never be guaranteed.

9.Entry and health requirements

The client is responsible for completing the entry requirements for Brazil and, where applicable, Argentina (visit to the Argentine side of Iguazu Falls): valid passport, any visa or travel authorization, vaccinations and health formalities.

Any information Brazil Vip provides about entry requirements is for guidance only. Entry requirements for Brazil depend on each traveler’s nationality: each traveler is responsible for checking them before departure with the Brazilian consulate in their country of residence or with the relevant authorities.

A traveler who is unable to board or to enter a country for lack of valid documents is not entitled to any refund.

10.Insurance

Prices do not include insurance. Brazil Vip strongly recommends taking out insurance covering assistance, repatriation and cancellation, within the purchase deadline set by the insurer.

We recommend comprehensive travel insurance (medical expenses, evacuation and trip cancellation), to be purchased directly by the client from an insurer of their choice within 48 hours of paying the deposit. Some credit cards also include coverage: check with your card issuer.

11.Liability

Brazil Vip is responsible for the proper performance of the services booked through it. However, it cannot be held liable where the damage results from:

  • the client’s own conduct, in particular missing, expired or non-compliant identity, travel or health documents, or late check-in (the full price remains due);
  • the unforeseeable and unavoidable act of a third party unconnected with the provision of the services;
  • unavoidable and extraordinary circumstances: natural disasters, weather conditions, political unrest, strikes, air traffic congestion, a decision by an administrative authority or a security measure.

Additional costs caused by such events (hotel nights, meals, transportation) are borne by the client, subject to the coverage provided by their insurance.

12.Personal data

Brazil Vip collects the data needed to prepare the quote and organize the trip (identity, contact details, flight information, preferences). This data is shared only with the suppliers concerned (hotels, guides, transport providers) and is never sold or rented to third parties.

This data is processed in compliance with applicable regulations, in particular Brazilian law (LGPD) and, for travelers residing in the European Union, the General Data Protection Regulation (GDPR). Details of the processing and of your rights are set out in our Privacy Policy.

Card payments are processed by the secure WeTravel platform: Brazil Vip does not have access to your full card details.

13.Complaints and governing law

Any complaint relating to a trip must be sent in writing to contact@brazilvip.com or by mail to the agency’s address, preferably within 30 days of the end of the trip, together with any relevant supporting documents. We undertake to respond as quickly as possible.

During the trip, any problem must be reported immediately to our team, available 7 days a week, so that a solution can be found on the spot.

Governing law and jurisdiction

These Terms and Conditions are governed by Brazilian law. Any dispute relating to their interpretation or performance falls within the jurisdiction of the courts of São Paulo (SP), Brazil, without prejudice to the mandatory provisions applicable to consumers.
